Rockets guard Kevin Porter is having one assault charge against him dropped after it was found he didn’t break his girlfriend’s neck in an alleged fight in a hotel room, prosectors said in Manhattan Criminal Court on Monday.
Manhattan Assistant District Attorney Mirah Curzer said the office was dropping the charge of second-degree assault against Porter due to “insufficient evidence,” that he broke former WNBA player Kysre Gondrezick’s neck.
“What initially appeared to be a fractured vertebrae was not in fact an injury caused by the defendant,” Curzer said during Porter’s hearing.
Documents reviewed by The Post show the fracture was a “congenital defect and did not come from the row.”
Judge Jay Weiner agreed to drop the charge but warned KPJ to stay out of any other physical altercations with Gondrezick.
“I don’t know what your relationship is with the complainant,” the judge said. “But if things get heated, you have to be the one who walks away.”
Porter Jr. will still face charges of second-degree strangulation and third-degree assault.
If he was to be convicted on the strangulation charge, the 23-year-old would face a maximum of seven years in prison.
Porter was offered a plea deal on the lower third-degree assault charge, which included counseling, but this offer was rejected.
The charges all stem from an incident that took place at the Millennium Hilton New York at 1 UN Plaza where Porter allegedly hit and choked Gondrezick until she struggled to breathe.
The Rockets are trying to trade Porter due to the charges and he is not with the team during their preseason games.
